The company register
Two government decrees of 21 January 2019, published in the Journal Officiel de la République Tunisienne (JORT, Official Journal of the Tunisian Republic) n° 7 of 22 January 2019, cite law 2018-52 of 29 October 2018 on the registre national des entreprises 1. The register is run by the Centre National du Registre des Entreprises 1.
The centre issues a certificat de réservation (reservation certificate) for a company name, trade name or shop sign on the day the request is filed. It is valid for six months and can be renewed once 1. The centre publishes a daily list of reserved names in its journal électronique officiel (official electronic journal) 1.
Government decree 2019-54 sets the rules for identifying the bénéficiaire effectif (beneficial owner). For a legal person, this is first any natural person who holds, directly or indirectly, 20 percent or more of the capital or voting rights 2. The register's website returned a page with no readable content when tried on 7 November 2026, so its search tools and fees are not described.
Land registration and the land court
Law 2001-35 of 17 April 2001 amended the Code des droits réels (real rights code). New article 316 states that the Conservation de la Propriété Foncière (land registry) has a central administration in Tunis and regional directorates 4. It establishes titles after registration judgments, keeps records of registered properties, enters rights and charges, keeps titles up to date and issues titles and certificates 4.
Law 2001-34 of 10 April 2001 deals with updating land titles. Article 2 makes the Tribunal Immobilier (land court) the only court competent for these procedures 5. The court acts through the chambre des titres gelés (chamber for frozen titles) or the juge du livre foncier (land book judge) 5.
Access to information and personal data
The Instance d'Accès à l'Information (INAI, access to information authority) describes itself as an independent public authority with legal personality and financial autonomy. It was created by organic law 22 of 2016 dated 24 March 2016 on the right of access to information, and parliament elected its council members on 18 July 2017 3.
The INAI site lists a joint guide with al-Hay'a al-Wataniya li-Himayat al-Ma'tiyat al-Shakhsiya (national authority for the protection of personal data) on how the two rights fit together 3. The data protection authority's own website (inpdp.tn) did not respond when tried on 7 November 2026, so its procedures are not described.
Courts and judgments
Beyond the land court, no official Tunisian source on the court structure or on access to published judgments was opened for this page.
